Discriminatory wording from the state’s ancient election statutes has been retained even though much has shifted since New Mexico has become a state.
Even though its electorate adopted the constitutional amendment to modernize the state’s election law in the past, the state’s Supreme Court decided 5-0 that it will eventually go into force. Interestingly, the judges rejected a contention by a state agency that ballot issues from 2010 and 2014 required 75 percent support.
